Privacy Policy
1. Privacy at a glance
General information
The following information provides a simple overview of what happens to your personal data when you visit our website. Personal data is any data that can be used to identify you personally. For detailed information on data protection, please refer to our privacy policy set out below.
Data collection on our website
Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. You can find the operator’s contact details in the legal notice (Impressum) of this website.
How do we collect your data?
On the one hand, your data is collected when you provide it to us. This may, for example, be data that you enter into a contact form. Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. web browser, operating system or time of the page request). This data is collected automatically as soon as you enter our website.
What do we use your data for?
Part of the data is collected to ensure that the website is provided without errors. Other data may be used to analyse your user behaviour – but only if you have given your prior consent.
What rights do you have regarding your data?
You have the right at any time to obtain information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the rectification, restriction of processing or erasure of this data. If you have given consent to data processing, you can withdraw this consent at any time with effect for the future. You can contact us at any time at the address given in the legal notice regarding this and any other questions on data protection. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
Analysis tools and third-party tools
When you visit our website, your browsing behaviour may be evaluated statistically. This only happens if you have agreed to it via our cookie banner (category “Statistics”), and is done using Google Analytics. The analysis is pseudonymous; we cannot directly attribute the browsing behaviour to you as a person. Likewise, the Google Maps map is only loaded after your consent. You can withdraw your consent at any time via the “Cookie settings” link at the bottom of every page. Detailed information can be found in the following privacy policy.
2. General information and mandatory information
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various personal data is collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
Please note that data transmission over the internet (e.g. when communicating by e-mail) may have security gaps. Complete protection of data against access by third parties is not possible.
Information on the controller
The controller responsible for data processing on this website is:
Yannick Gantert
Rohrbacher Straße 26
69115 Heidelberg, Germany
Phone: +49 6221 7275433
E-mail: info@gantert-physio.de
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).
Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for which it was processed no longer applies. If you assert a justified request for erasure or withdraw your consent to data processing, your data will be erased unless we have other legally permissible reasons for storing your personal data (e.g. statutory retention periods); in the latter case, the data will be erased once these reasons cease to apply.
Note on data transfers to the USA
Our website integrates services from Google (Google Analytics, Google Maps) – only with your consent. In this context, personal data may be transferred to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework (DPF). The European Commission has determined that companies certified under the DPF provide an adequate level of data protection (adequacy decision pursuant to Art. 45 GDPR). Further information is available at https://www.dataprivacyframework.gov/.
Withdrawal of your consent to data processing
Some data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time with effect for the future – for Google Analytics and Google Maps most easily via the “Cookie settings” link at the bottom of every page, otherwise by sending us an informal message. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. The legal basis on which each processing operation is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21(1) GDPR).
If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection pursuant to Art. 21(2) GDPR). We do not use your data for direct marketing.
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of data protection law, the data subject has the right to lodge a complaint with the competent supervisory authority. The competent supervisory authority for data protection matters is the data protection commissioner of the federal state in which our company is based. A list of the data protection commissioners and their contact details can be found at the following link: https://www.bfdi.bund.de/DE/Service/Anschriften/Laender/Laender-node.html.
The authority competent for us is: Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg (State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg), Heilbronner Straße 35, 70191 Stuttgart, Germany, https://www.baden-wuerttemberg.datenschutz.de/.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address bar of the browser changes from “http://” to “https://” and by the lock symbol in your browser bar.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, rectification and erasure
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to rectification or erasure of this data. You can contact us at any time at the address given in the legal notice regarding this and any other questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data, in particular if you dispute the accuracy of the data stored by us, if the processing is unlawful, if we no longer need the data but you require it for the establishment, exercise or defence of legal claims, or if you have lodged an objection pursuant to Art. 21 GDPR and it has not yet been determined whose interests prevail (Art. 18 GDPR). You can contact us at any time at the address given in the legal notice for this purpose.
Objection to advertising e-mails
We hereby object to the use of contact data published within the scope of the legal notice obligation for sending advertising and information material that has not been expressly requested. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited advertising information being sent, for example by spam e-mails.
3. Data collection on our website
Hosting
This website is operated on our own web server, which we rent from the following provider: Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. The server is located in a data centre in Germany.
All data arising when the website is accessed (in particular the server log files mentioned below and the contents of the contact form) is processed on this server. The hosting provider is used on the basis of Art. 6(1)(f) GDPR; we have a legitimate interest in the secure, fast and reliable provision of our website. A data processing agreement pursuant to Art. 28 GDPR has been concluded with the hosting provider.
Cookies and local storage
Our website itself does not set any cookies. There are no user accounts, no comment function and no newsletter. The language selection (German/English) is part of the page address (/en/) and is not stored in a cookie.
The only thing stored in your browser is your choice in the cookie banner (see “Consent via our consent banner”). Only if you consent to the category “Statistics” does Google Analytics set cookies on your device (see “Google Analytics”). When the Google Maps map is loaded (only after your consent), Google may also set cookies or store or read information on your device.
Information is stored on or accessed from your device on the basis of Section 25(2) No. 2 TDDDG (German Telecommunications Digital Services Data Protection Act) where this is strictly necessary for technical reasons, and otherwise only with your consent pursuant to Section 25(1) TDDDG and Art. 6(1)(a) GDPR. You can also configure your browser to inform you about the setting of cookies, to allow cookies only in individual cases or to exclude them in general, and to automatically delete cookies and stored website data when the browser is closed.
Consent via our consent banner
On your first visit, we use a banner to ask whether you consent to the use of Google Analytics (category “Statistics”) and Google Maps (category “External media”). The banner is our own development; no external consent service is used.
Your choice (the selected categories and the time of your decision) is stored exclusively in your browser’s local storage (localStorage, entry “gp_consent”) and is not transmitted to our server or to third parties. The entry remains stored until you delete it (e.g. by clearing the website data in your browser) or change your choice; after 12 months we will ask you again. You can change or withdraw your choice at any time via the “Cookie settings” link at the bottom of every page.
Storing your choice is technically necessary in order to respect your decision (Section 25(2) No. 2 TDDDG). Insofar as personal data is processed in this context, the legal basis is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR.
Server log files
The web server automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- IP address
- date and time of the server request
- requested page or file (URL) and request method
- HTTP status code and amount of data transferred
- referrer URL (the previously visited page)
- browser type and version as well as operating system used (user agent)
This data is not merged with other data sources. The data is collected on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the technically error-free presentation and the security of our website (e.g. to detect and defend against attacks); for this purpose, the server log files must be recorded. The log files are automatically deleted after 14 days.
Contact form
If you send us an enquiry via the contact form, we process the data you enter (name, e-mail address, message) as well as the answer to the security question, which serves solely to protect against automated spam. The information is received by a script on our own web server and forwarded by e-mail to our practice mailbox (info@gantert-physio.de); the e-mail additionally contains the page from which the form was sent. The form contents are not stored in a database on the web server. No external form service is used. We do not pass on this data without your consent.
The processing is based on Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for taking steps prior to entering into a contract (e.g. an appointment request). In all other cases, the processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR).
Please do not send us detailed information about your health (e.g. diagnoses, findings or medical documents) via the contact form. For an appointment request, your contact details and a short description of your concern are sufficient; we will be happy to discuss everything else in person or by phone. If you nevertheless voluntarily provide us with health data, we process it on the basis of your consent (Art. 9(2)(a) GDPR) or – insofar as this is necessary for initiating treatment – pursuant to Art. 9(2)(h), (3) GDPR in conjunction with Section 22(1) No. 1(b) BDSG (German Federal Data Protection Act). We are bound by professional confidentiality.
The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Enquiries from the contact form are not transferred to patient records. We delete them as soon as your enquiry has been fully dealt with, but no later than after 12 months. Mandatory statutory provisions – in particular retention periods – remain unaffected.
Enquiries by e-mail or telephone
If you contact us by e-mail or telephone, your enquiry including all resulting personal data (name, contact details, concern) will be stored and processed by us for the purpose of handling your request. The legal bases and storage period correspond to the information on the contact form. Our e-mail mailbox (also for messages from the contact form) is operated by Microsoft (Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland) as part of Microsoft 365; a data processing agreement has been concluded with Microsoft. A transfer to Microsoft Corporation in the USA cannot be ruled out; Microsoft Corporation is certified under the EU-US Data Privacy Framework.
4. Plugins and tools
The footer of our website contains a simple link to our Facebook page (https://www.facebook.com/PhysiotherapieGantert). This is not a plugin: no data is transmitted to Facebook when you visit our website, and no Facebook pixel is used. Only when you click on the link will you be taken to Facebook’s website; from then on, Facebook’s privacy policy applies.
We have a profile on Facebook. The provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. Data may also be transferred to Meta Platforms, Inc. in the USA; this company is certified under the EU-US Data Privacy Framework. When you visit our Facebook page, we and Meta are jointly responsible for the creation of page statistics (“Insights”) (Art. 26 GDPR). You can view the corresponding agreement at the following link: https://www.facebook.com/legal/terms/page_controller_addendum. You can adjust your advertising settings yourself in your user account: https://www.facebook.com/settings?tab=ads. For details, please refer to Facebook’s privacy policy: https://www.facebook.com/privacy/policy/.
Google Maps
On our contact page, you can display a map from the Google Maps service. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
The map is only loaded after you have consented to the category “External media” via the cookie banner or clicked on the “Load map” placeholder. Before that, no connection to Google is established. As soon as the map is loaded, data is transmitted to Google, in particular your IP address, the page visited and technical information about your browser and device; Google may also set cookies or store information on your device. Data may also be transferred to Google LLC in the USA; Google LLC is certified under the EU-US Data Privacy Framework. We have no influence on this data processing by Google.
The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You can withdraw your consent at any time via the “Cookie settings” link at the bottom of every page.
More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
Google Analytics
This website uses – only with your consent – functions of the web analytics service Google Analytics 4. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables us to evaluate the behaviour of website visitors statistically in order to improve our website. For this purpose, data such as pages viewed, time spent, origin of the visit (referrer), approximate location (country/region), device, browser and operating system used are recorded and combined in pseudonymous user profiles. Google Analytics is only loaded after you have consented to the category “Statistics” via the cookie banner.
We have configured Google Analytics to collect as little data as possible: Google Signals and ad personalisation are disabled; Google Ads, remarketing and other advertising features are not used. According to Google, IP addresses are not logged or stored in Google Analytics 4. The data collected is generally transferred to Google servers; a transfer to Google LLC in the USA is also possible. Google LLC is certified under the EU-US Data Privacy Framework.
After your consent, Google Analytics sets the following cookies:
- _ga – used to distinguish visitors; storage period 2 years
- _ga_BXG5P1LCBD – used to persist the session state; storage period 2 years
The analytics data stored by Google is automatically deleted after 14 months.
The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You can withdraw your consent at any time with effect for the future by deselecting the category “Statistics” via the “Cookie settings” link at the bottom of every page. In addition, you can delete cookies that have already been set in your browser.
More information on the handling of user data by Google Analytics can be found in Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.
Data processing agreement
We have concluded a data processing agreement with Google, which ensures that Google processes the data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
Locally hosted fonts
This website uses the font “Montserrat” and icon fonts (Font Awesome). The fonts are installed locally on our server. No connection to servers of Google (Google Fonts) or other third-party providers is established.
